Plantarium: Plant ID & Care — Terms of Use

IMPORTANT — PLEASE READ BEFORE USING THE SERVICE. These Terms of Use (the "Terms") govern your access to and use of the Plantarium: Plant ID & Care mobile application ("Plantarium"), the website plantarium.io, our web onboarding funnels, and all related identification, care, and diagnosis features — together, the "Service".
HOW TO CANCEL:
- Apple App Store: Settings → your name → Subscriptions → Plantarium → Cancel, at least 24 hours before the end of the free trial or the current billing period.
- Google Play: Play Store → profile icon → Payments & subscriptions → Subscriptions → Plantarium → Cancel subscription, at least 24 hours before the end of the free trial or the current billing period.
- Website (plantarium.io) subscription: open the app, go to the You tab and tap Manage or cancel subscription — this opens your billing portal, where you can cancel immediately. You can also use the cancellation link in your reminder email, or email support@plantarium.io with the subject "CANCEL MY SUBSCRIPTION".
- California residents may cancel online at any time (see §6.5).
1. Acceptance of Terms and Parties
The Service is operated by Alvin AI Studio LLC ("Company", "we", "us"), 447 Broadway, 2nd Floor Suite 3007, New York, NY 10013, USA, as Merchant of Record for web purchases, together with our technical provider identified in Section 11.
By using the Service you confirm that you are at least 18 years old, or at least 16 with the consent of a parent or guardian where local law permits, have the legal capacity to enter into a binding agreement, and agree to these Terms and to our Privacy Policy.
We may revise these Terms at any time. Material changes will be communicated via in-app notification, email, or website banner, and take effect on the stated date.
2. Safety Disclaimer — Wild Plants, Mushrooms, and Foraging (Not Professional Advice)
Plantarium is a plant, mushroom, and pest identification and care service using photo-based AI identification, diagnosis suggestions, and care guidance.
- Plantarium is not a botanist, mycologist, toxicologist, veterinarian, or physician, and is not a substitute for professional botanical, mycological, horticultural, toxicological, or medical advice.
- AI identification is an estimate, not a certainty. Species suggestions, confidence scores, diagnosis results, and care recommendations may be inaccurate, incomplete, or wrong — including for species that closely resemble toxic or dangerous look-alikes.
- Never eat, drink, smoke, touch, apply to your skin, or feed to any person or animal any plant, mushroom, fungus, berry, or other organism based on an identification, diagnosis, or suggestion from the Service. Always obtain independent confirmation from a qualified human expert (e.g. a licensed mycologist, botanist, or experienced local forager) before acting on the identity of any wild plant or fungus, and follow all local laws on foraging and protected species.
- If you suspect poisoning or any adverse reaction from a plant or fungus — in yourself, another person, or an animal — contact your local emergency services or poison control center immediately. Do not consult the Service or wait for a response from it before seeking emergency help.
- To the maximum extent permitted by law, the Company and our technical provider disclaim all liability for injury, illness, death, or property damage arising from reliance on any identification, diagnosis, or care/foraging-related suggestion provided by the Service. Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our proven gross negligence or willful misconduct.
3. Account Registration
Plantarium does not use a traditional sign-in. Your entitlement is linked to an anonymous device identifier generated on your device. If you purchase through our website, we additionally link the email address you provide at checkout to that identifier, solely so you can restore access if you reinstall the app or switch devices (see our Privacy Policy).
You are responsible for the security of your device and for using the correct email address for restore-access requests. You may request deletion of your data at any time by contacting support@plantarium.io.
4. The Service
Core features are available for free, with optional Premium features (identification across plants, mushrooms, and pests, diagnosis, light-meter and care tools, and similar) unlocked via subscription.
4.1 Fair Usage Policy
"Unlimited" identification and diagnosis, as referenced in our marketing and in-app copy, is subject to a fair usage limit intended to cover normal personal use — currently 50 combined identification/diagnosis requests per calendar month across every identification type (plant, mushroom, pest, and disease diagnosis), shared as a single pool rather than 50 per type. This limit resets at the start of each calendar month and applies equally regardless of subscription plan. We may adjust this limit from time to time to maintain the quality and availability of the Service for all users; any such change will not reduce the limit below a level reasonable for ordinary personal use of the Service.
The Service includes an in-app AI assistant ("Ari") for plant-care questions. Your messages and any photographs you attach are processed by our AI provider to generate a response (see our Privacy Policy). We may add, change, or discontinue features, and may modify, suspend, or discontinue any part of the Service at any time, subject to reasonable notice for material changes.
5. Intellectual Property and User Content
The Plantarium brand, application, software, and databases are owned by the Company or licensed to it by our technical provider. When you submit photographs, messages, or other content ("User Content"), you grant the Company a worldwide, royalty-free license to process, store, and use it to provide and improve the Service — including transmitting photographs to third-party identification-technology providers to generate identification results — in accordance with the Privacy Policy. This license terminates as soon as technically reasonable upon deletion of your data.
6. Payments, Subscriptions, Auto-Renewal & Refunds
6.1 Billing & Merchant of Record
Website purchases are processed by our payment provider (Stripe) and may appear on your statement under a merchant-of-record billing descriptor rather than the "Plantarium" name. App Store purchases are processed by Apple, and Apple is the seller of record for those purchases. Google Play purchases are processed by Google, and Google Play is the seller of record for those purchases.
6.2 Price Changes
We may change the price of a website subscription for future billing periods. For an existing subscriber, we will give at least 30 days' notice (by email or in-app) before a price increase takes effect; continuing your subscription after that date means you accept the new price. If you don't agree to the new price, you may cancel before it takes effect as described in Section 6.5. This does not apply to App Store or Google Play subscriptions, where price changes are presented and consented to directly through Apple's or Google's own subscription system.
6.3 Auto-Renewal Disclosure (Please Read)
Subscriptions are recurring. Unless you cancel, your subscription automatically renews at the end of each billing period, and the payment method on file is charged the then-current price for the next period. If your plan includes a free trial, you will be charged automatically when the trial ends unless you cancel before it ends. The price, billing frequency, and renewal terms are shown to you at checkout before you pay.
By starting your subscription you request that we begin providing the Service immediately, and you acknowledge that once the Service has been fully performed you lose the statutory 14-day right of withdrawal available under EU and UK consumer law for digital content. Where the Service has only been partly performed, that right is reduced proportionately rather than lost.
6.4 Reminders
Where required by law or app-store rules, we send a reminder before a free trial converts to a paid subscription and before certain renewals.
6.5 How to Cancel (incl. California / Click-to-Cancel)
You may cancel at any time as described at the top of these Terms. California residents (and others where required) may cancel online without steps more burdensome than sign-up. Cancellation stops future renewals; it does not retroactively refund the current period except as set out below.
6.6 Refunds
- App Store purchases are refunded by Apple under Apple's policies.
- Google Play purchases are refunded by Google under Google Play's policies — usually refundable within 48 hours directly from your order history in the Play Store. After that window, contact us at support@plantarium.io and we will raise the request with Google.
- Website subscription fees are non-refundable except where required by law — including the EU/UK 14-day right of withdrawal for digital purchases (where applicable, and subject to your consent to immediate performance under Section 6.3), and any mandatory local consumer-protection right, including rights arising from defective performance.
7. User Representations and Restrictions
You represent that you are at least 18 years old, or at least 16 with the consent of a parent or guardian where local law permits, and that you have legal capacity to enter into these Terms, and will use the Service for lawful, personal, non-commercial purposes only. You agree not to reverse-engineer, resell, or scrape the Service, upload infringing or harmful content, interfere with its systems (including its scan-limit and entitlement checks), abuse the AI assistant, impersonate others, or use the Service in violation of any law protecting endangered or protected plant and fungal species.
8. Limitation of Liability
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of, or inability to use, the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including mandatory consumer rights, or the disclaimer and liability provisions already set out in Section 2.
9. Termination
We may suspend or terminate your access if you violate these Terms or engage in unlawful or harmful activity. You may stop using the Service and request deletion of your data at any time.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Turkey, and the courts of Istanbul (Çağlayan) have jurisdiction — without prejudice to the mandatory consumer-protection rights and the courts available to you in your country of residence (including the EEA, UK, and US), which continue to apply where the law so requires.
